Description

  • Advise on the legal and regulatory aspects of Proof’s AI and machine learning use, including identity verification, biometric comparison, and fraud detection.
  • Build and operate Proof’s AI governance framework, including model risk, transparency, fairness, and vendor AI assessments.
  • Advise on automated decision-making, profiling, bias audits, and related AI regulations such as NYC Local Law 144 and California CPPA ADMT requirements.
  • Review AI-related product features, training data practices, and AI terms in customer and vendor agreements.
  • Serve as legal advisor on global privacy and data protection matters, including U.S. state privacy laws, GLBA, BIPA, HIPAA where applicable, and GDPR/UK GDPR.
  • Manage and mature Proof’s privacy program, including policies, data maps, records of processing, impact assessments, retention schedules, and privacy-by-design reviews.
  • Work with commercial counsel on data processing agreements, standard contractual clauses, and privacy terms with customers, vendors, and partners.
  • Advise product and engineering teams on the handling of identity data, biometrics, and notarization recordings across the data lifecycle.
  • Manage consumer and data-subject rights requests, privacy notices, consent flows, and cookie/tracking compliance.
  • Partner with security on information security legal matters, breach assessment and notification, incident response, and vendor security reviews.
  • Act as a trusted advisor to executives and product leaders, and create training, playbooks, and self-serve resources to improve privacy and security fluency across the company.
  • Support regulatory inquiries, audits, customer due diligence, RFPs, and other compliance responses.

Requirements

  • J.D. and active membership in good standing in at least one U.S. state bar.
  • 6+ years of relevant legal experience in a law firm and/or in-house setting, with a substantial focus on privacy and data protection.
  • Deep, current knowledge of U.S. privacy laws, including CCPA/CPRA, state comprehensive privacy laws, GLBA, and BIPA, with working fluency in GDPR.
  • Experience operationalizing privacy by designing and running programs in a fast-moving product environment.
  • Strong drafting and negotiation skills for DPAs and other data-related commercial terms.
  • Excellent judgment and communication skills with the ability to translate complex legal requirements into actionable guidance for non-lawyers.
  • Ability to work independently and manage competing priorities in a high-growth company.
  • Experience advising on biometric data and/or e-signature and online notarization regulatory regimes.
  • Understanding of technology and machine learning.
  • Experience at an identity, fintech, security, healthcare, or other regulated-data company.
  • Familiarity with AI/ML governance and emerging AI regulation, including the EU AI Act and NIST AI RMF.
  • Working knowledge of security frameworks such as SOC 2, ISO, and NIST, plus incident response.
  • Privacy certifications such as CIPP/US, CIPP/E, CIPM, or CIPT are preferred.
  • AI governance certification such as IAPP AIGP is preferred.
  • Security certifications such as CISSP, CISM, CISA, or CCSP are preferred.
