Description

  • Serve as the front-line legal advisor to customer-facing teams on ERISA, IRC, fiduciary, and disclosure questions across the customer lifecycle.
  • Advise on complex plan sponsor and participant issues, including time-sensitive matters involving EPCRS, anti-cutback concerns, and participant disclosures.
  • Review participant-facing communications, SPDs, SMMs, and plan sponsor disclosures for ERISA compliance, including the workflows that generate them.
  • Determine when fee disclosures are required under ERISA Section 408(b)(2), Section 404(a)(5), and related rules, and advise on their content.
  • Translate technical ERISA conclusions into plain-language guidance that internal teams can deliver to customers.
  • Serve as the ERISA subject matter expert for product teams designing and building new features.
  • Translate ERISA and IRC requirements into clear guidance that product managers and engineers can build against.
  • Pressure-test how proposed automation handles edge cases and identify fiduciary duty implications for 3(16), 3(21), and 3(38) features.
  • Synthesize learnings from customer matters to identify platform limitations, edge cases, and systemic gaps for product improvement.
  • Stay current on legislative, regulatory, and judicial developments affecting qualified retirement plans and advise internal teams on resulting changes.
  • Draft and maintain internal policies, procedures, legal guidance, and educational resources to support consistent ERISA application.

Requirements

  • 5–8 years of substantive ERISA experience focused on qualified retirement plans and fiduciary matters, including 401(k), 403(b), and IRA plans.
  • At least 2 of those years must be at a law firm practicing in this area.
  • Demonstrated experience with qualified plan operational compliance, including EPCRS and correction principles for qualified retirement plans.
  • Working knowledge of ERISA fiduciary duty and prohibited transaction rules as they apply to plan administration and service provider arrangements.
  • Experience advising non-legal business teams on ERISA issues in real time and translating legal conclusions into actionable guidance.
  • Strong working knowledge of IRC qualification rules applicable to 401(k) plans.
  • Admitted to the bar and in good standing, or otherwise authorized to practice law in any state.
  • Active use of modern AI tools in legal work for research, drafting, summarization, and analysis.
  • Deep substantive ERISA expertise rather than generalist legal experience.
  • Experience providing ERISA advice in operational and product contexts with strong business judgment.
  • Strong collaboration and communication skills for working across product, engineering, operations, and customer-facing teams.
  • Preferred: in-house experience at a recordkeeper, TPA, fintech, or trust company.
  • Preferred: direct experience with 3(16), 3(21), or 3(38) fiduciary operations at a recordkeeper or TPA.
  • Preferred: experience providing ERISA input on product, operational, or technology decisions.
