Description

  • Review advertising claims, product labeling, and marketing materials across web, email, social, paid media, and packaging for FDA, FTC, and state consumer protection compliance.
  • Evaluate claims against FDA labeling and promotion requirements and coordinate with Regulatory Affairs on substantiation, off-label risks, and FDA guidance.
  • Develop legal tools and processes that embed claim substantiation and consumer protection compliance into marketing workflows.
  • Advise Regulatory Affairs, Clinical, Quality, Medical, Product, and Marketing teams on claims and compliance matters.
  • Support legal review of clinical trials and research initiatives informing marketing claims.
  • Monitor developments in FDA and FTC advertising, promotion, clinical research, and consumer protection law and provide actionable guidance.
  • Balance legal and regulatory risks with business objectives while delivering practical solutions in a fast-paced environment.

Requirements

  • Juris Doctor degree from an ABA-accredited law school.
  • Active bar membership in at least one U.S. jurisdiction and eligibility to practice in-house in the state of residence.
  • 5+ years of law firm and/or in-house legal experience.
  • Substantive experience reviewing advertising and promotional claims, preferably for FDA-regulated products.
  • Working knowledge of FDA and FTC advertising, promotion, and claim substantiation requirements.
  • Ability to make practical legal judgments quickly amid shifting priorities and ambiguity.
  • Strong communication and relationship-building skills with cross-functional teams.
  • Experience supporting clinical trials, research, or medical/legal/regulatory review preferred.
  • In-house experience in healthcare, pharmaceutical, medical device, consumer health, or telehealth preferred.
  • Familiarity with clinical data, real-world evidence, consumer goods, health tech, digital products, or AI-powered products preferred.
