Description

  • Design and own the criteria and controls for legal escalation of post charge-off accounts.
  • Monitor the legal escalation pipeline, review exceptions, and maintain compliance and audit logs.
  • Review and approve settlement letters, deficiency collection scripts, and settlement authority structures.
  • Own legal and compliance reporting for the collections KPI package and prepare quarterly Board updates.
  • Perform FDCPA, UDAAP, ECOA, SCRA, and state-law reviews of consumer-facing processes and materials.
  • Build and maintain a state-by-state legal viability map for deficiency collections.
  • Manage bankruptcy filings, regulatory inquiries, state attorney general matters, and escalated consumer complaints.
  • Vet, audit, and monitor third-party collection agencies and BPO partners, including contracts, call audits, and remediation.
  • Lead outside counsel evaluation, account referrals, case tracking, and cost monitoring for legal escalation matters.
  • Write and maintain policies, procedures, training materials, and process documentation for the post charge-off program.
  • Serve as the day-to-day legal and compliance resource for collections staff and leadership.
  • Hire and develop direct reports as the program grows.

Requirements

  • 5+ years of experience in legal operations, compliance management, or collections oversight within consumer lending, auto finance, or a third-party collection agency.
  • Experience in non-prime or subprime auto lending.
  • Working knowledge of FDCPA, UDAAP, and applicable state consumer protection laws.
  • Experience managing bankruptcy filings and SCRA compliance for servicemember accounts.
  • Experience managing outside counsel relationships, including scoping work, reviewing billing, and escalating performance issues.
  • Experience working in or alongside a deficiency recovery operation.
  • Ability to read and interpret collections performance data.
  • Bachelor's degree required.
  • JD, paralegal certification, or CRCM preferred but not required.
  • Experience designing or leading a post charge-off deficiency recovery program from the ground up is strongly preferred.
  • Experience managing legal collections activity across multiple states is strongly preferred.
  • Experience building or administering an agency compliance monitoring program is strongly preferred.
  • Background at a non-prime auto lender or servicer is strongly preferred.
  • Demonstrated historical career stability.
